Perbandingan Standar Pembuktian Praktek Terkoordinasi dalam Price Fixing Agreement Berdasarkan Hukum Persaingan Usaha Indonesia dan Uni Eropa

The evolution of modern cartel modus operandi demonstrates a growing dynamic where business actors increasingly avoid direct agreements, shifting instead toward tacit coordination or concerted practices. In price-fixing practices, market players rationally exploit normative loopholes by coordinating through informal meetings, sensitive information exchanges, or market signaling without leaving a written trail. This phenomenon poses serious law enforcement challenges, particularly in Indonesia, where the doctrine of concerted practices has not yet been recognized under Law Number 5 of 1999, causing evidentiary efforts against tacit coordination to frequently fail due to the limitations of indirect evidence. This paper aims to examine and analyze legal certainty regarding the standard of proof for concerted practices in Price Fixing Agreement cases, from the perspective of the evidentiary systems in Indonesia and the European Union. The research methodology employed in this study is normative legal research with a prescriptive approach. This study recommends the adoption of the concerted practices doctrine through legislative revision or judicial precedent to strengthen competition law enforcement in Indonesia.
Perkembangan modus operandi kartel modern menunjukkan dinamika pelaku usaha yang semakin menghindari perjanjian langsung dan beralih pada praktik koordinasi terselubung atau concerted practice. Dalam praktik penetapan harga, pelaku usaha secara rasional memanfaatkan celah normatif dengan melakukan koordinasi melalui pertemuan informal, pertukaran informasi sensitif, atau sinyal pasar tanpa meninggalkan bukti tertulis. Fenomena ini menciptakan tantangan penegakan hukum yang serius, khususnya di Indonesia yang belum mengenal doktrin concerted practices dalam Undang-Undang Nomor 5 Tahun 1999, sehingga pembuktian terhadap koordinasi terselubung sering kali gagal karena keterbatasan alat bukti tidak langsung. Tulisan ini bertujuan untuk mengetahui dan menganalisis kepastian hukum dalam pembuktian terhadap praktek koordinasi terselubung dalam perkara Price Fixing Agreement, ditinjau dari sistem pembuktian di Indonesia dan Uni Eropa. Metode penelitian yang digunakan dalam penulisan ini adalah metode penelitian hukum normatif yang bersifat preskriptif. Penelitian ini merekomendasikan adopsi doktrin concerted practices melalui revisi UU atau yurisprudensi untuk memperkuat penegakan hukum persaingan usaha di Indonesia.
