Abstract

General of Intellectual Property (DJKI), and the legal standing of parties in trademark cancellation proceedings involving foreign well-known trademarks. The problem arises from the tension between the private-law validity of an assignment, the publicity function of recordal, and the application of error in persona, which may terminate proceedings before the merits are examined. This study employs normative legal research with a descriptive-analytical specification using statutory, case, conceptual, and analytical approaches. Legal materials were collected through document study and analyzed qualitatively using deductive reasoning. The findings show that assignment and recordal perform different legal functions. An assignment may establish a legal relationship between the parties, while recordal serves a publicity function and determines the extent to which the transfer may operate against third parties. Accordingly, a transfer that remains pending before the registry should not be treated mechanically as eliminating all legal relevance of the former registered owner in cancellation proceedings. Legal standing should be assessed by considering the underlying legal relationship, the timing of the transfer, the recordal status, and the parties bound by the requested relief. Where the transferee must be involved, that involvement must follow a procedurally valid amendment initiated by the plaintiff or an intervention sought by the interested third party; the court may not add a defendant ex officio. This harmonized approach is necessary to preserve procedural certainty without reducing substantive protection for foreign well-known trademarks.
