Abstract

ABSTRAK

 

Tujuan penelitian ini yaitu untuk mengkaji permasalahan status hukum pelaku investasi aset kripto di Indonesia dan efektivitas peraturan perundang-undangan di Indonesia sebagai bentuk dari perlindungan konsumen dalam investasi pada aset kripto. Penelitian ini menggunakan metode yuridis empiris dengan pendekatan berbasis perundang-undangan, serta konsep dari teori ilmu hukum, yang bersumber pada bahan hukum primer dan sekunder. Hasil dari penelitian ini menunjukan status hukum pelaku investasi aset kripto di Indonesia telah memperoleh legitimasi melalui berbagai peraturan perundang-undangan terkhususnya dalam Peraturan Bappebti Nomor 5 Tahun 2019 tentang Ketentuan Teknis Penyelenggaraan Pasar Fisik Aset Kripto (Crypto Asset) Di Bursa Berjangka. Keabsahan transaksi aset kripto juga telah memenuhi syarat-syarat perjanjian sebagaimana diatur dalam Pasal 1320 KUH Perdata. Meskipun demikian, efektivitas peraturan perundang-undangan dalam memberikan perlindungan hukum bagi pelaku investasi aset kripto masih menghadapi berbagai tantangan. Walaupun telah terdapat kerangka hukum yang komprehensif, implementasi perlindungan hukum dari berbagai produk hukum tersebut belum optimal. Hal ini tercermin dari masih maraknya kejahatan terkait aset kripto seperti penipuan, penggelapan, dan serangan phishing yang menimbulkan kerugian signifikan bagi pelaku investasi. Permasalahan ini diperparah dengan adanya ketidakjelasan dalam beberapa aspek regulasi, seperti mekanisme penyelesaian sengketa dan penegakan hukum lintas yurisdiksi, serta keterbatasan dalam kapasitas pengawasan oleh otoritas terkait.

ABSTRACT

 

The purpose of this study is to examine the problem of the legal status of crypto asset investment actors in Indonesia and the effectiveness of laws and regulations in Indonesia as a form of consumer protection in investing in crypto assets. This research uses empirical juridical methods with a legislation-based approach, as well as concepts from legal science theory, which are sourced from primary and secondary legal materials. The results of this study show that the legal status of crypto asset investment actors in Indonesia has been legitimized through various laws and regulations, especially in Bappebti Regulation Number 5 of 2019 concerning Technical Provisions for the Implementation of the Crypto Asset Physical Market on the Futures Exchange. The validity of crypto asset transactions has also fulfilled the terms of the agreement as stipulated in Article 1320 of the Civil Code. Nevertheless, the effectiveness of laws and regulations in providing legal protection for crypto asset investment actors still faces various challenges. Although there is a comprehensive legal framework, the implementation of legal protection from these various legal products has not been optimal. This is reflected in the prevalence of crimes related to crypto assets such as fraud, embezzlement, and phishing attacks that cause significant losses to investment actors. This problem is exacerbated by the lack of clarity in several aspects of the regulation, such as dispute resolution mechanisms and cross-jurisdictional law enforcement, as well as limitations in supervisory capacity by relevant authorities.

    Was born on April 11, 1984, with last education at the Notary Magister of Gadjah Mada University in Yogyakarta, accepted as a civil servant lecturer since 2018, and has been actively teaching at Udayana University since 2010. Currently serves in the civil law department with expertise in consumer protection and labor law. Currently pursuing doctoral education at Udayana University.
