PEKERJA RUMAH TANGGA DAN PERLINDUNGAN HUKUMNYA MELALUI PERSPEKTIF THE DIFFERENCE PRINCIPLE

Abstrak

Tujuan penulisan artikel ini guna membahas dan menelaah penerapan RUU PPRT melalui pandangan prinsip keadilan John Rawls yaitu the difference principle serta pengimplementasian regulasi tersebut dari sudut pandang kepentingan PRT. Penyusunan tulisan berikut mempergunakan metode studi hukum normatif melalui pendekatan perundang-undangan. Hasil penelitian mengungkapkan terdapat kelemahan dalam Undang- Undang Ketenagakerjaan serta Peraturan Menteri Ketenagakerjaan tentang Perlindungan Pekerja Rumah Tangga guna memberikan perlindungan hukum bagi PRT, sehingga keberadaan RUU PPRT diharapkan terjadi kesepakatan yang seimbang antara Pemberi Kerja dengan Pekerja melalui kesamaan dan kesetaraan di dalam prinsip John Rawls, sehingga mampu melindungi kedudukan PRT yang lebih lemah dari kedudukan Pemberi Kerja.

ABSTRACT

The aim of writing this article to discuss and examine the implementation of the PPRT Bill through the John Rawls' view of the principle of justice, namely the difference principle, and execution of the regulation from point of view interestsof domestic workers. The preliminaries of the following article apply a normative legal study method with a legislative approach. The research outcome explain that there are weaknesses in the Manpower Law and the Regulation of the Minister of Manpower concerning the Protection of Domestic Workers in order to offer legal protection for domestic workers, so that the existence of the PPRT Bill is expected to create a balanced agreement between Employers and Workers through equality and equality in the principles of John Rawls, so able to protect position of domestic workers who are weaker than the position of Employers.
