KONFLIK KEBIJAKAN IMPOR PAKAIAN BEKAS: TANTANGAN KEPASTIAN HUKUM DI INDONESIA

Abstrak

Penelitian ini bertujuan untuk menganalisis konflik norma antara Pasal 2 ayat (3) huruf d Peraturan Menteri Perdagangan No. 18 Tahun 2021 dengan tarif bea No. 6/PMK.010/2022 yang memperbolehkan impor pakaian bekas dengan pembebanan sebesar 35%. Metode dalam penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan pada peraturan perundang-undangan dan studi literatur untuk menganalisis ketidaksesuaian regulasi dan dampak hukum pada pelaksanaan perdagangan impor pakaian bekas di Indonesia. Hasil studi menunjukkan bahwa adanya konflik norma ini menimbulkan ketidakpastian hukum dan kebingungan pelaku usaha serta aparat penegak hukum, yang pada akhirnya akan menghambat efektivitas pengendalian impor pakaian bekas.

ABSTRACT

This study aims to analyze the conflict of norms between Article 2 section (3) letter d of the Regulation of the Minister of Trade Number 18 of 2021 with the Regulation of the Minister of Finance Number 6/PMK.010/2022 which permits the import of used clothing with an import duty tariff of 35%. The method in this study uses a normative legal research method with an approach to statutory regulations and literature study to analyze regulatory inconsistencies and legal impacts on the implementation of the import trade of used clothing in Indonesia. The results of the study indicate that this conflict of norms creates legal uncertainly and confusion for business actors and law enforcement officials, which will ultimately hinder the effectiveness of controlling the import of used clothing.
