EFEKTIVITAS PENERAPAN PERAMPASAN ASET DALAM MENCEGAH DAN MEMBERANTAS KORUPSI

Abstract

Studi ini bertujuan untuk menganalisis sejauh mana efektivitas kebijakan perampasan aset dalam mendukung upaya pemberantasan Tindak Pidana Korupsi. Tulisan ini menerapkan metode normatif dengan pendekatan berbasis peraturan perundang-undangan serta konsep hukum. Hasil studi menunjukan bahwa Korupsi telah menjadi kejahatan transnasional yang mempersulit upaya pemulihan aset karena masalah yurisdiksi. Indonesia's Corruption Perception Index (CPI) turun secara signifikan pada tahun 2022, yang mengindikasikan strategi anti-korupsi yang tidak efektif. Pendekatan perampasan aset yang saat ini bergantung pada putusan pengadilan dinilai belum memadai. Studi ini mengeksplorasi perampasan aset tanpa melalui proses peradilan, dengan fokus pada penelusuran dan penyitaan aset yang diperoleh secara koruptif. Konsep ini bertujuan untuk mendukung strategi follow the money & follow the asset dengan tetap menghormati hak asasi manusia. Model yang diusulkan ini bertujuan untuk meningkatkan mekanisme pemulihan aset di Indonesia, mengatasi kelemahan dalam undang-undang yang ada, dan meningkatkan upaya antikorupsi secara keseluruhan.

ABSTRACT

This study aims to analyze the effectiveness of asset forfeiture policies in supporting efforts to eradicate corruption. This paper applies a normative method with a legislation-based approach and legal concepts. The study results show that Corruption has become a transnational crime that complicates asset recovery efforts due to jurisdictional issues. Indonesia's Corruption Perception Index (CPI) dropped significantly by 2022, indicating an ineffective anti-corruption strategy. The current approach to asset forfeiture that relies on court decisions is considered inadequate. This study explores non-judicial asset forfeiture, with a focus on tracing and seizing corruptly acquired assets. The concept aims to support the follow the money & follow the asset strategy while respecting human rights. The proposed model aims to improve asset recovery mechanisms in Indonesia, address weaknesses in existing laws, and enhance overall anti-corruption efforts.
