Article Retraction, Withdrawal, and Correction Policy

Policy Statement

Acta Comitas: Jurnal Hukum Kenotariatan recognizes and appreciates the efforts and hard work of authors in preparing and refining their manuscripts, including their willingness to follow all peer review procedures established by the journal. Nevertheless, under certain circumstances, published articles may be subject to removal or retraction. Corrections, clarifications, retractions, or apologies may be issued when justified, particularly when an article is found to have violated publication ethics.

All such actions shall be carried out in accordance with strict procedures and criteria to maintain the integrity, credibility, and reliability of the journal's electronic archives. In implementing this policy, Acta Comitas: Jurnal Hukum Kenotariatan is committed to maintaining the quality, integrity, and completeness of scientific documents that serve as sources of information for researchers and librarians.

Article Retraction

An article may be retracted when there are indications that it violates scientific principles or publication ethics. Such violations may include simultaneous submission to more than one publisher (double submission), false authorship claims, plagiarism, manipulation or unauthorized use of data, inclusion of fictitious authors, and other forms of scientific or ethical misconduct.

Retraction may also be undertaken when necessary to correct errors that occurred during the submission process or after the article has been published. Retraction may be initiated at the request of the author or based on a decision by the Editor, taking into consideration the recommendations of the Editorial Board of Acta Comitas: Jurnal Hukum Kenotariatan.

The forms of article retraction that may be applied by Acta Comitas: Jurnal Hukum Kenotariatan include:

  1. If an indication of a violation of the scientific code of ethics is identified before the article is published, the Editor shall return the manuscript to the author and issue a retraction letter from the Editor-in-Chief;
  2. If a violation of the scientific code of ethics is identified after the article has been published, retraction may be carried out through the following mechanisms:
    1. The online article shall be preceded by a page containing a retraction note. Readers shall first be directed to this page before accessing the article;
    2. The original version of the article shall remain available without substantive changes; however, each page of the PDF file shall contain a watermark stating that the article has been retracted;
    3. The HTML version of the article shall be removed from the journal's online system.

To ensure that every retraction is conducted in accordance with best practices in scholarly publishing and the COPE Retraction Guidelines, Acta Comitas: Jurnal Hukum Kenotariatan shall apply the following procedures:

  1. Any allegation or issue concerning an article shall be brought to the attention of the Journal Editor for further consideration;
  2. The Journal Editor shall conduct an investigation in accordance with the procedures set out in the COPE flowcharts, including considering and evaluating the response of the author concerned;
  3. Before a final decision is made, the Editor's report and findings shall be submitted to the Editorial Board of Acta Comitas: Jurnal Hukum Kenotariatan for consideration and recommendations concerning the relevant ethical issues. This stage is intended to ensure consistency in decision-making and compliance with publication ethics principles;
  4. The final decision concerning the retraction of an article shall be communicated to the author and, where deemed necessary, to other relevant parties, including the institution with which the author is affiliated;
  5. The Retraction Statement shall be published online and included in the next available issue of the journal.

Article Withdrawal

An article may be withdrawn if the initial version of the manuscript contains errors or if the manuscript has inadvertently been submitted more than once to Acta Comitas: Jurnal Hukum Kenotariatan and/or another publisher. Withdrawal may also be carried out when an article contains elements of scientific or ethical misconduct, including double submission, false authorship claims, plagiarism, self-plagiarism, unauthorized or fraudulent use of data, or other forms of misconduct.

If an author becomes aware that their article contains elements of an ethical violation, the author may request withdrawal of the article by submitting a written withdrawal statement to the Editorial Board of Acta Comitas: Jurnal Hukum Kenotariatan.

Article Correction

Acta Comitas: Jurnal Hukum Kenotariatan may publish a correction to an article under certain circumstances, including:

  1. A limited portion of the publication is found to contain inaccurate data or potentially misleading information, while the publication as a whole remains reliable, particularly when the error resulted from an unintentional mistake;
  2. There is an inaccuracy in the list of authors or contributors, such as when a person who meets the authorship criteria has been omitted from the author list, or when a person who does not meet the authorship criteria has been included as an author.

Corrections to articles that have undergone peer review are classified into the following three categories:

  1. Publisher Correction/Erratum: issued to inform readers of a significant error originating from the publisher or journal staff, generally involving a production error. Such an error may affect the publication record, the scientific integrity of the article, or the reputation of the authors or the journal;
  2. Author Correction/Corrigendum: issued when a significant error originating from the author is identified and such error affects the publication record, the scientific integrity of the article, or the reputation of the author or the journal;
  3. Addendum: additional information or material provided by the authors to clarify inconsistencies, supplement or expand upon previously published work, or update information contained in the main article.

The determination of whether a correction is necessary shall be at the discretion of the Journal Editor. In making such a decision, the Editor may consider input from the Reviewer or members of the Editorial Board where necessary. The Editor responsible for the article shall request clarification from the author regarding the identified issue. Nevertheless, the final decision as to whether a correction is required and which type of correction is appropriate shall rest entirely with the Editor.

Article Removal: Legal Limitations

The removal of an article from the online database of Acta Comitas: Jurnal Hukum Kenotariatan shall only be carried out in very limited circumstances and where there are clear legal grounds. Such action may be taken if an article is defamatory, constitutes a fraudulent or fabricated work, infringes the legal rights of another party, is subject to a court order requiring its removal, or poses a potential threat to national security.

Where an article is removed for legal reasons, its metadata, including the title and names of the authors, shall remain in the journal's database. The content of the article shall instead be replaced with a notice page explaining that the article has been removed for legal reasons.

Article Replacement

If a published article may pose a serious risk if used or acted upon, the author may request the retraction of the problematic version of the article and its replacement with a corrected version.

In such circumstances, the retraction procedure shall still apply. However, the retraction notice in the journal's database shall include a link to the corrected and republished version of the article, together with a document history indicating the revisions made to the article.
